China drafts new safety standards for autonomous driving systems – “black box” emergency stop assist

BEIJING — China’s Ministry of Industry and Information Technology (MIIT) has unveiled a new draft of mandatory safety standards for autonomous driving systems, marking a significant step in regulating next-generation vehicle technology and enhancing road safety nationwide. The draft standard, titled Intelligent Connected Vehicles – Safety Requirements for Autonomous Driving Systems, was released for public comment and is expected to take effect on July 1, 2027.

Unlike previous voluntary guidelines, the proposed standards will require all autonomous systems used in vehicles sold or operated in China to meet strict safety benchmarks or face prohibition from production, sale, and import once fully adopted. This move comes amid a growing number of accidents globally involving automated driving features — from robotaxis to advanced driver-assistance systems — and reflects Beijing’s commitment to balancing innovation with public protection.

Raising the Safety Bar for Level 3 Automation

At the core of the draft is a higher safety baseline for Level 3 (L3) autonomous driving systems, a category defined by the Society of Automotive Engineers (SAE) as “conditional driving automation.” L3 systems are designed to perform all driving tasks under designated conditions, but the human driver must remain ready to take over at any time.

Under the proposed standards, L3 systems must now be capable of executing minimal risk manoeuvres independently if the driver fails to respond to a takeover request — a requirement that effectively brings L3 performance closer to Level 4 (L4), where no active driver intervention is needed in controlled environments. This includes functions such as safely changing lanes and bringing the vehicle to a stop in a safe location that does not obstruct traffic, reducing the risk of collisions during emergencies such as sudden illness or loss of consciousness.

Industry experts have noted that this represents a significant shift from past expectations for L3 systems, which traditionally require human drivers to remain actively engaged. By empowering vehicles to respond autonomously in critical situations, regulators hope to improve safety outcomes and increase public confidence in autonomous technologies.

Data Recording & “Black Box” Requirements

Another key component of the draft is the introduction of a mandatory Autonomous Driving Data Recording System (DSSAD) — often likened to an aircraft’s “black box.” All autonomous vehicles will be required to install DSSADs that accurately record operational data, allowing authorities and investigators to reconstruct events in the aftermath of traffic incidents involving automated systems.

The DSSAD requirement builds on China’s recent national standard for data recording systems in intelligent connected vehicles, which came into force in January 2026, and is expected to play a central role in future crash investigations and regulatory enforcement.

From Voluntary to Mandatory: A Regulatory Shift

Once finalized, the draft will replace the existing voluntary standardGeneral Technical Requirements for Autonomous Driving Systems of Intelligent Connected Vehicles — which was adopted in September 2024. The key distinction is that while recommended standards offer guidance, mandatory standards carry legal weight and must be complied with by all manufacturers and technology developers in China.

To ease the transition, the draft proposes a 13-month compliance window for vehicles that have already been approved under previous guidelines. This means automakers and tech firms will have time to upgrade systems to meet the new requirements before enforcement begins in mid-2027.

Implications for the Automotive Industry

The stricter safety framework is expected to accelerate innovation in autonomous driving technologies, especially within China’s rapidly expanding intelligent vehicle sector. By pushing L3 systems closer to L4 performance expectations — including independent emergency responses — regulators are encouraging developers to focus on robust, fail-safe features that can protect drivers, passengers, and other road users.

At the same time, mandatory data recording requirements may lend new transparency to investigations involving automated vehicles and create clearer paths for determining liability and improving future designs.
