Doctors Face Growing Legal Pressure As Patients Become More Aware Of Their Rights

KUALA LUMPUR, JULY 2026 – Doctors in Malaysia are now facing a more challenging healthcare environment as patients become increasingly aware of their rights and expectations in medical treatment. Beyond providing clinical care, medical professionals must also be more cautious about complaints, investigations and possible legal action.

Former Director of the Ethics and Legal Division at the Malaysian Medical Council and IDEAL Advisory founder, Dr. Faizi Rosli, said the healthcare landscape today is very different from the past. He explained that every medical decision is no longer viewed only from a treatment perspective, but also through legal and ethical considerations.

According to Dr. Faizi, many medical disputes are not caused solely by poor treatment. Instead, they often involve unclear communication, incomplete medical records, issues involving patient consent, confidentiality concerns and professional boundaries between doctors and patients.

He said some complaints happen because patients do not fully understand the risks of treatment before giving their consent. This makes informed consent a key part of modern medical practice, as patients must receive clear and sufficient explanation before agreeing to any procedure or treatment plan.

The issue has become more serious as several medical negligence cases in Malaysia have resulted in high compensation awards. Some cases have reportedly exceeded RM8 million, while one recent case recorded compensation of nearly RM9.5 million, making it among the highest ever awarded in the country.

Dr. Faizi stressed that medicolegal awareness is not meant to help doctors avoid responsibility. Instead, it is intended to help healthcare workers deliver safer, more transparent and more ethical treatment for the benefit of patients.

He also highlighted that stronger communication, complete records and ethical decision-making can reduce misunderstanding between doctors and patients. When treatment options, risks and decisions are properly explained and documented, both sides are better protected.

The matter was discussed after the Clinical Ethics and Medicolegal Workshop: Protecting Your Practice, which gathered doctors and healthcare professionals to examine issues related to clinical ethics, professional communication and legal responsibility in medical practice.
