Indonesia ratifies new Criminal Procedure Code (KUHAP) to accompany new Criminal Code starting in 2026

Indonesia, El Sky News – The Indonesian House of Representatives (DPR) has officially passed the Draft Law on the Criminal Procedure Code (KUHAP) into law. The new law will come into effect alongside the new Penal Code (KUHP) on 2 January 2026, following the recent approval of the KUHP.

The legislation was ratified during a plenary session on Tuesday, 18 November 2025, at the DPR building in Jakarta. The session was attended by 342 members of parliament and chaired by DPR Speaker Puan Maharani, assisted by Deputy Speakers Sufmi Dasco Ahmad, Saan Mustopa, and Cucun Ahmad Syamsurijal. The approval was unanimous after the Speaker asked members:
“Can the KUHAP bill be approved as law? Agree!” said Puan Maharani, to which all participants responded “agree.”

The new KUHAP is designed to align criminal procedure law with the new Penal Code, while strengthening the rights of suspects, defendants, and victims. Key points of the new KUHAP include:
