Kayveas Fails in Appeal to Challenge Maglin’s Appointment as myPPP President

KUALA LUMPUR, AUGUST 2026 — The Court of Appeal has dismissed Tan Sri M. Kayveas’ appeal against a High Court decision that rejected his application for leave to begin judicial review proceedings over the appointment of Datuk Seri Maglin Dennis D’Cruz as president of the People’s Progressive Party (myPPP).

The unanimous decision was delivered by a three-member panel comprising judges Datuk Lim Chong Fong, Datuk Dr Lim Hock Leng and Datuk Ahmad Shahrir Mohd Salleh.

Justice Lim Hock Leng said the High Court was correct in deciding that the matter could not be determined by the courts due to Section 18C of the Societies Act. The court also noted that Kayveas was no longer a party member, meaning any judgment on the matter would effectively be academic.

Although the threshold for obtaining leave to begin judicial review proceedings is generally low, the Court of Appeal found that Kayveas’ application did not meet the required standard.

The High Court had previously dismissed his application on November 20, 2023. Kayveas had sought to challenge an April 11, 2023 decision by the Home Ministry’s Registration of Nationality and Societies Division that withdrew the cancellation of myPPP’s registration.

myPPP had been deregistered on January 14, 2019, following an internal dispute involving party members and office bearers. Kayveas also sought a declaration that the party’s annual general meeting held on March 19, 2023, where D’Cruz was appointed president, was invalid.

The latest Court of Appeal ruling leaves the earlier High Court decision intact and effectively ends Kayveas’ attempt through these proceedings to challenge D’Cruz’s appointment as myPPP president.
