KUALA LUMPUR, JULY 2026 – A physically disabled man was sentenced to 14 months in prison and fined RM3,000 by the Magistrate’s Court after pleading guilty to breaking into a house and stealing several valuable items last month.
Magistrate Ellyna Othman ordered 33-year-old S. Guna to serve the prison sentence from the date of his arrest on July 3. He will face an additional nine months in prison should he fail to pay the fine.
According to the charge, Guna allegedly committed the offence with Myanmar national Mohd Sharuf Nizam Mohd Hanif, 26, and another individual who remains at large.
The group was accused of breaking into a house belonging to a 27-year-old woman and stealing a gold chain, a gold bracelet, three gold pendants and a mobile phone. The incident occurred at a residence in Jalan Bukit Setongkol, Taman Muhibah, Kuantan, at approximately 9.58am on June 25.
Guna was charged under Section 457 of the Penal Code. The provision carries a prison sentence of up to five years for house trespass, which may be extended to a maximum of 14 years and accompanied by a fine when theft is committed.
Deputy public prosecutor B. Deevagaran Naidu requested an appropriate sentence that would serve as a lesson to the accused and deter him from committing a similar offence in the future.
Guna’s lawyer from the National Legal Aid Foundation, Rahiza Zulkifli, appealed for a lighter sentence. The defence told the court that Guna was physically disabled, received RM650 in monthly assistance from the Social Welfare Department and was responsible for supporting his wife and three children.
In the same proceedings, Mohd Sharuf Nizam pleaded not guilty to the charge. He is also a holder of a refugee card issued by the United Nations High Commissioner for Refugees.
The prosecution proposed bail of RM7,000 with two sureties. However, defence lawyer Mohd Shuhairil Ziqrul Sapi requested a lower amount, explaining that his client earned RM1,400 per month while working for an environmental and solid-waste management company and supported his wife and one child.
